These terms and conditions apply to all transactions on this site. Please read them carefully. They do not affect your statutory rights.

This site is owned and operated by FUNFACTORY ('FUNFACTORY', 'we' or 'us' or 'our'). These terms and conditions apply to the use of this website and by accessing this website and/or placing an order you agree to be bound by the terms and conditions set out here. If you do not agree to be bound by these terms and conditions you may not use or access this website.

The Contract Between Us
Any contract for purchases made through the website will be with FUNFACTORY. FUNFACTORY must receive payment of the whole of the price for the goods that you order before your order can be accepted, and the contract formed.

Once payment has been received FUNFACTORY will confirm that your order has been received by sending an email to you at the email address you provide in your registration form. The shipment email will include your name, the order number and the total price. FUNFACTORY’s acceptance of your order brings into existence a legally binding contract between us on these terms. Any term sought to be imposed by you in your order will not form part of the contract.

FUNFACTORY is entitled to withdraw from any contract in the case of obvious errors or inaccuracies regarding the goods appearing on our website. If an error or inaccuracy is discovered with regards to the advertised price of the goods that you have ordered, we will contact you as soon as possible by e-mail. This will be to inform you of the correct price of the goods, and to ask you if you wish to continue with the order at the amended price, or to cancel the order altogether.

General Terms
These terms and conditions and all transactions relating to this website are governed by English law and are subject to the non–exclusive jurisdiction of the English courts. We do not accept amendments to these terms and conditions.

Additional terms and conditions may apply for prize competitions, online bidding, pre–release orders and our added value services and offers. If so, you will be alerted to them at the relevant juncture.

These terms and conditions only cover the FUNFACTORY website. Any other websites which are linked to from this site are governed by their own terms and conditions. We accept no responsibility or liability for the content or operation of websites, which are not under our control. We are required by law to tell you that sales can be concluded in English only and that no public filing requirements apply.

Payment Details
FUNFACTORY accepts payment by Visa, MasterCard,  Switch, Maestro and Delta. All product prices and delivery charges are shown in UK pounds sterling. Your payment card company will perform any currency conversion.

Upon receiving your order FUNFACTORY carries out a standard pre-authorisation check on your payment card to ensure there are sufficient funds in order to fulfil the transaction. No payment is debited from your card during this pre-authorisation check. Your card will only be charged upon dispatch of the items in your order. Your card will not be debited for items in your order which have not been dispatched, apart from magazine subscriptions, which, due to their nature are invoiced before the magazine is dispatched.

Availability of Goods You Order
If FUNFACTORY has insufficient stock to deliver the goods ordered by you, we will notify you as soon as possible and any sum debited by FUNFACTORY from your credit card will be re-credited to your account and FUNFACTORY will notify you by email at the address given by you in your order form. The refund will be made as soon as possible and in any event within 30 days of your order. FUNFACTORY will not be obliged to offer any additional compensation for disappointment suffered.

Please note: we endeavour to bring our customers the best value we can by running special offers, but please remember stocks are limited at the special offer price, and subject to availability. We update our website as quickly as we can to minimise disappointment. The process of updating the website when goods have sold out at promotional price can take a few hours to update.

Changes to This Agreement
FUNFACTORY reserves the right to make changes to our site, policies, and these terms and conditions at any time. If any of these conditions shall be deemed invalid, void, or for any reason unforeseen, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.

What ever you want to be we have a large a selection of fancy dress costumes to suit all.

OUR NORMAL HIRE IS A 2 DAY HIRE, BUT IF YOU WOULD LIKE THE HIRED ITEMS FOR LONGER THEN PLEASE LET US KNOW!!!!!!

PLEASE NOTE WE DO NOT HIRE OUT CHILDREN'S COSTUMES

HIRE TERMS & CONDTIONS

-  YOU MUST BE 18 years or over  TO MAKE A BOOKING.

- A holding deposit must be left with FunFactory Fancy Dress the amount charged will be in relation to the costume category as specified on the hire agreement. Values as Specified below.

 Categories:-

A2 is to the value of £5.00 per item
‘’A1 is to the value of £10.00 per item
 ‘’A” is to the value of £20.00 per item
‘’B’’ is to a value of £30.00 per item
B1 is tothe value of £25.00
‘’C’’ is to a value of £50.00 per item
‘’D’’ is to a value of £100.00 per item
‘’E’’ is to a value of £150-200.00 per item

- All costumes hired remain the property of FUNFACTORY Fancy Dress 

-American Express, Amex, JCB cards and Cheques are not accepted

-The named hirer has the sole responsibility for the costume until the costume is returned to Funfactory's  premises

-Costumes cannot be changed once they have left the shop premises.

-Customers should check their costume thoroughly and advise the shop at your earliest opportunity, if you notice any damage, marks, or items missing. A message can be left on the answer phone, if we are un-able to answer due to busy periods, however if you fail to notice any damage then FUNFACTORY will assume that this is done by the hirer, then a charge will be made to the customer, BUT PLEASE REST ASSURED THAT EVERY SAFE GUARD IS TAKEN TO AVOID THIS BEFORE YOU HIRE.

- Customers must not attach sticky labels or badges to any part of the costume.

 - Part or all of the deposit will be forfeit or the cost or replacement charged if;
A costume is returned beyond reasonable repair
The costume is returned needing specialised cleaning
The costume is returned with permanent damage, i.e. cigarette burns
The costume is returned with one or more items missing
Any modifications have been carried out on the costume
The costume is returned with blood (or other body fluids)
The costume is not returned to Funfactory for whatever reason

- Original hangers must be returned; failure to do so will result in a £1 charge per missing hanger

-Customers must not wash costumes or tumble dry any wet item or Iron

-No refunds will be issued once a costume has been booked, this includes cancellation of your function, for whatever reason

- Should there be loss or damage to the costume, the replacement or repair will be charged to the debit, credit card information or deducted from the cash bond that the company holds as security bond.

 
- The deposit must be left in the form of Cash, Debit or Credit card Number.


 - It is the hirer’s responsibility to ensure that the garments are comfortable in fit and suitable for the purpose before leaving the Shop premises. FunFactory Fancy Dress can accept no responsibility for garments that are later deemed to be not suitable or ill fitting, and in some cases no refund of the hire fee can be considered.

 - If Any alterations or additions are made to the costume hired then FUNFACTORY will consider this damage and costs incurred in restoring the costume will be deducted from the deposit held.

 - All Costumes must be returned by the date specified on the hire agreement. Late returns will be charged at half the rate quoted for hire, per each two day hire period of non return, until the costume has been returned to FunFactory Fancy Dress. If after a week costume has still not been retuned it will be deemed lost and the hirer will be invoiced accordingly for the replacement of the costume.

-FunFactory Fancy Dress accepts no responsibility for any footwear or wigs hired. These are worn at the customers own risk. However every safe guard is taken to insure that these are thoroughly cleaned before each hire. This however does not affect your statutory rights as a consumer.
